Biography

Michael focuses his practice on commercial real estate transactions, business formation and business transactions, and condemnation matters. Michael has extensive experience in representing real estate purchasers, sellers, investors, developers, landlord and tenants in matters related to in the acquisition, sale, financing, development, and leasing of various types of commercial real estate properties.

He represents borrowers on traditional acquisition and construction to permanent loans. Michael represents tenants and landlords in commercial leasing transactions. He has substantial experience in counseling clients in corporate and business transactions as well as construction and development matters. Michael also maintains an active practice representing landowners and condemning authorities in eminent domain proceedings and litigating the value of the real property taken.

Michael’s substantial experience in civil litigation matters involving various real estate and business matters including construction defects, land use disputes, condemnation, inverse condemnation, zoning matters, contract and business disputes, title insurance claims, and landlord/tenant disputes uniquely positions him to advise clients in a variety of commercial real estate and business transactions.

Michael often speaks to select groups of bankers, developers and other real estate professionals about current trends and issues related to commercial real estate including financing, commercial leases, real property taxation and project development and financing. Prior to forming Rogers Lewis, Michael was a partner at Ellis Lawhorne & Sims, P.A. and practiced law at the Quinn Law Firm, LLC.

Representative Matters
  • The acquisition and development of tracts of land for use as various commercial uses including automobile dealerships, retail shopping centers with multiple national tenants, restaurants, retail properties, and the subsequent sale of completed projects.
  • Subdividing commercial tracts and creating multiple easement agreements in anticipation of subsequent transactions for the purchase and sale of the project as well as transactions involving land swaps with adjacent property owners.
  • Negotiating commercial leases for landlords and tenants for office space in multi-story towers and re-developed shopping malls and town centers.
  • Providing counsel to borrowers in connection with credit facilities made available to borrowers for the acquisition and development of commercial property and for corporate working capital.
  • Representation of Developers on multi-million dollar developments from start of the project through conclusion.
  • Representation of Landowners and Condemning Authorities in Eminent Domain proceedings.
  • Successfully challenged three eminent domain proceedings brought by The South Carolina Department of Transportation, resulting in the Action being dismissed and the condemnor paying all of Landowner’s attorney’s fees and costs.
